ESL Learning Press Terms of Use

These Terms of Use govern your use of the ESL Learning Press website, tools, services, accounts, and downloadable materials available through esllearningpress.com.

By using this website or its tools, you agree to these Terms. If you do not agree, please do not use the services.

1. About ESL Learning Press

ESL Learning Press is the name of the website and online service available at esllearningpress.com. It provides English-language teaching materials, educational resources, activity-building tools, author and book services, and related digital services.

References in these Terms to “ESL Learning Press,” “the website,” “we,” “us,” or “our” refer to the operator of the ESL Learning Press website and services.

2. Permitted use

You may use ESL Learning Press and its tools for lawful educational, teaching, learning, publishing, and related professional purposes.

You must not use the website or its services:

- in violation of applicable law;

- to infringe copyright, trademark, privacy, or other rights;

- to distribute unlawful, harmful, fraudulent, or misleading material;

- to interfere with the operation or security of the website;

- to attempt unauthorized access to accounts, systems, or data;

- to use automated methods to abuse, overload, scrape, or disrupt the service; or

- in any other way that could harm ESL Learning Press, its users, or third parties.

3. Third-party articles and source materials

Some ESL Learning Press tools, including Article Activity Builder, allow users to provide or retrieve text from third-party sources.

You are responsible for ensuring that your use of articles, text, images, and other third-party materials is permitted by applicable copyright law or authorized by the relevant rights holder.

Article Activity Builder is designed primarily for educational and classroom use. ESL Learning Press does not grant you any additional copyright or redistribution rights in third-party material.

In particular, generating an activity from an article does not itself give you permission to publish or distribute the complete article publicly.

Where generated materials include a source citation, link, or QR code, these are provided to identify and attribute the original source. Attribution does not replace any permission that may be required under copyright law.

4. Responsibility for materials you provide

You retain any rights you already hold in material that you submit, paste, upload, or otherwise provide to ESL Learning Press.

By providing material to a tool, you give ESL Learning Press the limited permission necessary to process that material and provide the requested service.

You represent that you have the right, permission, or other lawful basis to provide and use the material for that purpose.

ESL Learning Press does not claim ownership of third-party articles or other source material supplied by users.

5. Generated activities and educational materials

ESL Learning Press tools may generate activities including, but not limited to:

- multiple-choice questions;

- comprehension activities;

- vocabulary activities;

- crossword puzzles;

- word-bank exercises;

- vocabulary study sheets;

- Moodle-compatible files;

- PDFs and printable classroom materials.

You are responsible for reviewing generated materials before using them with students.

Generated questions, definitions, answers, distractors, explanations, classifications, and other content may occasionally contain errors or require editing.

ESL Learning Press does not guarantee that automatically generated material is error-free, complete, or appropriate for every learner or teaching context.

6. Artificial intelligence

Some ESL Learning Press tools use artificial intelligence to assist with generating or processing educational content.

AI-generated content may be inaccurate, incomplete, or unsuitable in some contexts.

Users should exercise professional judgment and review generated material before classroom, academic, publishing, or other use.

AI output should not be treated as authoritative professional, legal, medical, financial, or other specialist advice.

7. User accounts

Some features require an account.

You are responsible for:

- providing accurate account information;

- maintaining the security of your account;

- protecting login links, passwords, and authentication credentials; and

- activity carried out through your account.

You should notify ESL Learning Press if you believe your account has been accessed without authorization.

We may suspend or restrict accounts where reasonably necessary to protect the service, other users, or third parties.

8. Saved activities and user content

Where ESL Learning Press allows you to save activities, applications, author profiles, book information, or other material, reasonable steps are taken to maintain the service and stored data.

However, users should retain their own copies of important materials.

We cannot guarantee that stored data will always remain available indefinitely or without interruption.

9. Public sharing

Unless a feature specifically states otherwise, saved activities and source materials are intended for the account holder’s use and are not automatically made public.

You are responsible for any material that you subsequently publish, upload, share, distribute, or make publicly available outside ESL Learning Press.

You should not publicly distribute third-party copyrighted material unless you have permission or another lawful basis to do so.

10. ESL Learning Press content and intellectual property

Unless otherwise stated, the ESL Learning Press website, branding, logos, software, interface designs, original teaching materials, books, text, graphics, and other original content are owned by or licensed to ESL Learning Press and are protected by applicable intellectual-property laws.

You may not copy, reproduce, sell, republish, modify, reverse engineer, or commercially exploit ESL Learning Press software, website content, or proprietary materials except where expressly permitted.

The use of ESL Learning Press tools does not transfer ownership of the tools, software, branding, or underlying systems to the user.

11. Educational downloads

Where ESL Learning Press expressly provides materials for classroom use, teachers may use those materials in accordance with the license or instructions accompanying them.

Any third-party material incorporated into an activity remains subject to the rights applicable to that source material.

12. Book Partner Program and author services

Users who participate in the ESL Learning Press Book Partner Program may submit book information, author profiles, images, sample materials, links, and other publishing information.

By submitting such material, you confirm that you have the authority to provide it and to permit ESL Learning Press to display and process it for the Book Partner services you request.

You remain responsible for the accuracy of information you provide about books, authors, publishers, rights, ISBNs, ASINs, pricing, purchase links, and other publishing information.

Additional conditions displayed during an application, purchase, or subscription process may also apply.

13. Payments and paid services

Where a service requires payment, the applicable price and payment terms will be shown before purchase or approval.

Payments may be processed by third-party payment providers such as Stripe.

ESL Learning Press does not store full payment-card details where payment processing is handled by the payment provider.

Any specific cancellation, renewal, refund, or subscription terms shown for a paid service form part of these Terms.

14. Third-party websites and services

ESL Learning Press may contain links to third-party websites or interact with third-party services, including publishers, retailers, learning-management systems, social platforms, payment providers, and other services.

We do not control third-party websites and are not responsible for their content, availability, policies, security, or practices.

Use of a third-party service may also be subject to that provider’s own terms and privacy policy.

Affiliate Links and Commissions

Some links on ESL Learning Press, including links to Amazon and other retailers, may be affiliate links.

If you click one of these links and make a qualifying purchase, ESL Learning Press may earn a commission at no additional cost to you. Not all retailer links generate commissions.

15. Availability of the service

We may update, improve, modify, suspend, or discontinue parts of ESL Learning Press from time to time.

We aim to keep the services available and functioning correctly, but continuous or uninterrupted availability is not guaranteed.

Features may occasionally be unavailable because of maintenance, technical problems, third-party service interruptions, security measures, or circumstances outside our control.

16. No warranty

ESL Learning Press and its services are provided on an “as available” basis.

To the extent permitted by law, we do not guarantee that:

- the website will always be available;

- generated content will always be accurate;

- third-party websites will permit automatic article retrieval;

- downloadable files will work with every device or external platform; or

- the services will meet every individual user’s requirements.

Nothing in these Terms excludes any rights or protections that cannot lawfully be excluded.

17. Limitation of liability

To the extent permitted by applicable law, ESL Learning Press will not be responsible for indirect, incidental, consequential, or similar losses arising from use of the website or services.

This includes loss arising from:

- reliance on generated educational content;

- loss of stored activities or data;

- interruption of services;

- third-party websites or services;

- a user’s unauthorized use of copyrighted or other protected material; or

- a user’s distribution or publication of generated materials.

Nothing in these Terms limits liability where limitation or exclusion is prohibited by law.

18. Indemnity

To the extent permitted by law, you are responsible for claims, losses, or expenses arising from your unlawful use of the service, your infringement of third-party rights, or material you submit or distribute in violation of these Terms.

19. Privacy

Our collection and handling of personal information is described in the ESL Learning Press Privacy Policy.

The Privacy Policy should be read together with these Terms.

20. Changes to these Terms

We may update these Terms when our services, legal requirements, or business practices change.

The current version will be published on this page together with its effective date.

Continued use of the services after an updated version takes effect constitutes acceptance of the revised Terms where permitted by law.

21. Governing law

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles.

Any dispute relating to these Terms or the ESL Learning Press services will be subject to the jurisdiction of the competent courts of Japan, except where applicable law requires otherwise.
